Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Car Czar LLC, a Virginia limited liability company (“Car Czar,” “we,” “us”). They govern your use of carczar.app and the Car Czar mobile apps (together, the “Service”). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Our Privacy Policy explains what information we collect and how we use it, and is part of these Terms.

Who can use Car Czar

You must be at least 18 years old, or the age of majority where you live, to create an account. Someone between 13 and 18 may use Car Czar only as a member of a garage run by a parent or guardian who agrees to these Terms on their behalf. Car Czar is not for children under 13.

Your account

• Give us accurate information when you sign up and keep it current.
• Keep your password, and the Google, Facebook or Apple account you sign in with, secure. You are responsible for what happens under your account.
• Tell us promptly at privacy@carczar.app if you think someone else has gotten into your account.
• One person per account. Don't create accounts by automated means or on someone else's behalf without their permission.

An early product that will change

Car Czar is in active development and is currently free. We add, change and remove features regularly, and parts of the Service may be labelled alpha, beta or preview. We may change or discontinue any feature, or the Service as a whole, at any time. We will try to give reasonable notice before discontinuing the Service so you can export or keep your records, but we do not promise that it will always be available, uninterrupted or free of errors. If we ever introduce paid features, we will tell you what they cost before you are charged anything.

Information in Car Czar is guidance, not a guarantee

Car Czar brings together information from public sources, other providers, other users and our own estimates to help you look after your car. That information can be incomplete, out of date or wrong, and it is not professional, mechanical, legal or financial advice. In particular:

• Recalls and complaints come from the National Highway Traffic Safety Administration (NHTSA) and may lag behind or omit what the manufacturer has issued. Always confirm whether your vehicle has an open recall with the manufacturer, a dealer, or nhtsa.gov/recalls.
• Inspection, emissions and registration rules and fees vary by state and county and change over time. Your state or local motor vehicle agency is the authority, not Car Czar.
• Maintenance schedules, predictions and reminders are estimates. Your owner's manual and a qualified mechanic take precedence. A reminder can arrive late or not at all, for example if an email is filtered or a date you entered is wrong.
• Gas prices come from Google and from other Car Czar users, and may not match what the pump charges when you arrive.
• Cost, savings and value estimates, including the savings estimator on our home page, are illustrative and depend on your vehicle and how you drive.
• Vehicle details decoded from a VIN, and readings taken by the camera scanners, can be wrong. Check them before you save them.
• Car seat inspection stations are listed from NHTSA's directory. Call ahead to confirm hours and availability.

You remain responsible for the safety, maintenance, inspection, registration and insurance of your vehicles. Do not use Car Czar while you are driving.

Your content

“Your content” means what you put into Car Czar: vehicles, fill-ups, service records, costs, notes, reminders, and the receipts and documents you attach. You keep ownership of it. You give us a limited license to store, copy, process and display your content only as needed to run the Service for you and the people you choose to share it with, as described in the Privacy Policy.

• Only upload content you have the right to share, and don't upload anything unlawful or anything that infringes someone else's rights.
• Gas prices you log or report may be shown to other users anonymously, as the Privacy Policy describes. You can turn sharing off for prices you log; a price you submit with “Price wrong?” is always shared that way.
• Reviews you submit may be published on our website and in our marketing, with the name and vehicle you give us, and we may edit them for length. Submitting one gives us a non-exclusive, royalty-free, perpetual license to use it that way. We review submissions before publishing and may decline any of them.
• Feedback and suggestions are welcome, and we may use them without any obligation to you.

We may remove content that violates these Terms, but we do not review everything users store and are not responsible for content users provide.

Shared garages

You can invite other people to your garage. An accepted member can see the vehicles in it and their records, and add and edit entries. Only the garage's admin can delete, sell or transfer a vehicle, or hand the garage to someone else. Invite only people you trust with that access. An invitation can be accepted only by the email address it was sent to. You can remove a member at any time; what they logged stays with the vehicle.

Vehicle transfers

When you sell or give away a vehicle, you can transfer its Car Czar history to the new owner with a transfer code. Anyone who holds the code can accept the transfer, so treat it like a key and give it only to the person receiving the car. Once a transfer is accepted, the vehicle and its records move to the recipient's account and leave yours.

Car Czar is not a party to any sale. We do not verify title, ownership, mileage or condition, and a Car Czar history is a record kept by its previous owners. It is not a certified vehicle history report or proof of ownership.

Acceptable use

When using Car Czar, you agree not to:

• break the law, or use the Service to harass, defraud or harm anyone;
• access another person's account, garage, vehicles or files without their permission, or try to get around our security or access controls;
• submit gas prices, reviews or other information you know to be false;
• scrape, bulk-download or resell the Service or its data, or use bots or automated tools against it other than through features we provide;
• interfere with the Service, overload it, or introduce malware;
• copy, modify or reverse-engineer the Service except where the law expressly allows it.

Third-party services

Car Czar relies on services run by others, and your use of them through Car Czar is also subject to their own terms:

• Google Maps. Gas prices and station lookups use Google Maps Platform. By using those features you agree to be bound by the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy.
• Sign-in providers. If you sign in with Google, Facebook or Apple, that provider's terms apply to your account with them.
• Affiliate links and other websites. Car Czar is funded through affiliate links, and we may earn a commission if you buy something after following one. We do not control the sites they lead to, and are not responsible for their products, services, content or terms.

Our rights

The Service, including its software, design, text, logos and the Car Czar name, belongs to Car Czar LLC or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own, non-commercial purposes in line with these Terms. Nothing else is licensed to you.

Ending your use of Car Czar

You can stop using Car Czar at any time. To have your account and its data deleted, follow the steps on our Data Deletion page. If you are the admin of a garage that has other members, you will need to hand the garage to one of them before your account can be deleted, so that their access to its vehicles is not lost with yours.

We may suspend or close an account that violates these Terms, that creates risk or legal exposure for us or other users, or that has been inactive for an extended period. Where it is reasonable to do so, we will tell you first and give you a chance to keep your records. The sections on your content, disclaimers, limitation of liability, indemnification and disputes continue to apply after your use ends.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, CAR CZAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY INFORMATION IN IT, INCLUDING RECALL, INSPECTION, MAINTENANCE, PRICE OR COST INFORMATION, IS COMPLETE, CURRENT OR CORRECT.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAR CZAR LLC AND ITS MEMBERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR VEHICLE VALUE, OR FOR VEHICLE DAMAGE, REPAIR COSTS, FINES OR FEES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain warranties to be excluded or liability to be limited, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to defend, indemnify and hold harmless Car Czar LLC and its members, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising from your content, your violation of these Terms, or your violation of anyone else's rights.

Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. If you have a dispute with us, please contact us first. Most problems can be resolved informally, and we ask that you give us 30 days to try before starting any formal proceeding. Any claim that is not resolved that way must be brought in the state or federal courts located in Virginia, and you and Car Czar consent to the personal jurisdiction of those courts. Either party may bring an eligible claim in small claims court instead.

Mobile app stores

If you downloaded Car Czar from Apple's App Store or Google Play, these Terms are between you and Car Czar LLC, not Apple or Google. Car Czar, not Apple or Google, is responsible for the app and its content, for support and maintenance, and for handling any claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You also agree to follow the store's own usage rules.

Changes to these Terms

We may update these Terms as Car Czar changes. We will update the “Last updated” date above, and for material changes we will notify you by email or in the Service before they take effect. Continuing to use Car Czar after a change takes effect means you accept the updated Terms.

General

These Terms and the Privacy Policy are the entire agreement between you and Car Czar about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer these Terms or your account to someone else without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
